Khoryev regards Petersburg, a collection of essays by Jarosław Iwaszkiewicz, published in 1976, as a windup of the writer’s complex ties with Russian culture and literature, which he was widely known to have loved and known in depth. It is a book where, through the legendary city on the river Neva, Iwaszkiewicz takes a look at a number of essential issues of Russian history and its ties with the history of Poland and the Polish people. Iwaszkiewicz avoids unequivocal judgments, (...) noticing the antinomian nature of St. Petersburg, seen as a being full of contrast but at the same time the center of revolutions and despotism, a manifestation of imperial power and the highest achievements of sophisticated art. These contrasts reveal, in Khoryev’s opinion, the multi-faceted and fullest picture of St. Petersburg and its individuality: so mysterious, overpowering and unique. (shrink)

The Criminalization series arose from an interdisciplinary investigation into criminalization, focussing on the principles that might guide decisions about what kinds of conduct should be criminalized, and the forms that criminalization should take. Developing a normative theory of criminalization, the series tackles the key questions at the heart of the issue: what principles and goals should guide legislators in deciding what to criminalize? How should criminal wrongs be classified and differentiated? How should law enforcement officials apply the law's specifications of (...) offences? The sixth volume in the series offers a philosophical investigation of the relationship between moral wrongdoing and criminalization. Considering the justification of punishment, the nature of harm, the importance of autonomy, inchoate wrongdoing, the role of consent, and the role of the state, the book provides an account of the nature of moral wrongdoing, the sources of wrongdoing, why wrongdoing is the central target of the criminal law, and the ways in which criminalization of non-wrongful conduct might be permissible. This paper attempts three things. It invites you to engage critically with me in the adjudication of a particular controversy. It attempts to argue for and exemplify important procedures which distinguish good and bad thinking in a critical mode. And it argues the case for the separate teaching of critical thinking (henceforth CT).

Many fragments from Theophrastus on perception are preserved by the late Neoplatonist, Priscian of Lydia. After preliminary source criticism concerning how to identify the fragments, I turn to Theophrastus’ discussion of perceiving and perceptual awareness. While he clearly rejects literalism, he also does not embrace “spiritualism”: he argues instead that we receive the defining proportions of perceptible qualities in the sense organ, though in different contraries than in the perceptible (thereby avoiding literalism). If Priscian’s report is faithful, Theophrastus also accepts (...) a moderate capacity reading of De anima III.2, locating awareness in a central monitoring sense, common to the individual modalities; and this has further implications for the unity of consciousness. Theophrastus’ method, though aporetic in form, is nonetheless a constructive engagement with the same texts of Aristotle’s we have ourselves, in the service of a joint research program in psychology that he shared with his colleague and former teacher. Wittgenstein famously regarded philosophy as an activity and not as a body of doctrine. And yet within the secondary literature there is little agreement as to what Wittgenstein took the purpose of that activity to be. In this paper, I claim that the purpose of philosophical activity, at least according to the Later Wittgenstein, was to solve philosophical problems. As support for this claim, I argue that our everyday talk about the mind presents us with a philosophical problem about the (...) mind. Focusing then on what Wittgenstein says about understanding and using his distinction between internal and external relations, I show how we can solve this problem. If my reading is accepted, then the purpose of philosophical activity, according to the later Wittgenstein, was not therapy. As such, later Wittgenstein should not be read as a therapist. (shrink)

Western scholarship on religion and gender has devoted considerable attention to women’s entry into leadership roles across various religious traditions and denominations. However, very little is known about the dynamics of women’s religious authority and leadership in developing settings, especially in sub-Saharan Africa, a region of powerful and diverse religious expressions. This study employs a combination of uniquely rich and diverse data to examine women’s formal religious authority in a predominantly Christian setting in Mozambique. I first use survey data to (...) test hypotheses regarding the prevalence and patterns of women’s formal leadership across different denominational groups. I then support and extend the quantitative results with insights on pathways and consequences of women’s ascent to formal congregation authority drawn from qualitative data. The analysis illustrates how women’s religious authority both defies and reasserts the gendered constraints of the religious marketplace and the broader gender ideology in this developing context. This paper sheds light on the incongruent findings concerning the relationship between family involvement and firms’ corporate social responsibility. While prior studies have mainly taken the perspective of families’ socioemotional wealth preservation, we approach this relationship from the perspective of behavioral agency theory, highlighting the important role played by CEOs’ family memberships. Specifically, we posit that family firms are more likely to invest in CSR when their CEOs are members of the controlling families. Furthermore, we examine how family firms can (...) employ long-term incentives to encourage non-family CEOs to act in the interests of the controlling families to preserve SEW and thus enhancing family firms’ CSR performance. We tested our hypotheses using hand-collected data of family firms included in the S&P 500 index, in the period of 2003–2010. The empirical findings support our hypotheses that family firms with family members as the CEOs have better CSR performance and family firms tend to provide a high level of long-term incentives to non-family than family CEOs. In addition, long-term incentives strongly motivate CEOs to improve firms’ CSR performance, regardless of their family memberships. (shrink)

ABSTRACT There has been much discussion regarding the acceptable use of sedation for palliation. A particularly contentious practice concerns deep, continuous sedation given to patients who are not imminently dying and given without provision of hydration or nutrition, with the end result that death is hastened. This has been called ‘early terminal sedation’. Early terminal sedation is a practice composed of two legally and ethically accepted treatment options. Under certain conditions, patients have the right to reject hydration and nutrition, even (...) if these are life‐sustaining. Patients are also entitled to sedation as palliation for intolerable, intractable suffering. Though early terminal sedation is thought to be rare at present, the changing nature of palliative medicine suggests its use will increase. Arguments regarding early terminal sedation have failed to recognize early terminal sedation as a distinct legal and ethical entity. It can be seen as both the simple sum of treatment refusal and sedation for palliation, analogous to terminal sedation. It can also be seen as an indivisible palliative treatment, more analogous to assisted suicide or euthanasia. But ultimately, it is wholly analogous neither to terminal sedation given when death is imminent, nor to assisted suicide or euthanasia. This paper contends that early terminal sedation should be considered as a distinct entity. Such a reconception promises to provide a way forward in the debate, practice and policy regarding this contentious area of palliative medicine. (shrink)

The wedge hierarchy was originally defined and studied only in the Baire space (and some other zero-dimensional spaces). Here we extend the Wadge hierarchy of Borel sets to arbitrary topological spaces by providing a set-theoretic definition of all its levels. We show that our extension behaves well in second countable spaces and especially in quasi-Polish spaces. In particular, all levels are preserved by continuous open surjections between second countable spaces which implies e.g. several Hausdorff-Kuratowski-type theorems in quasi-Polish spaces. An interdisciplinary theoretical framework is proposed for analysing justice in global working conditions. In addition to gender and race as popular criteria to identify disadvantaged groups in organizations, in multinational corporations (MNCs) local employees (i.e. host country nationals (HCNs) working in foreign subsidiaries) deserve special attention. Their working conditions are often substantially worse than those of expatriates (i.e. parent country nationals temporarily assigned to a foreign subsidiary). Although a number of reasons have been put forward to justify such inequalities—usually with (...) efficiency goals in mind—recent studies have used equity theory to question the extent to which they are perceived as fair by HCNs. However, since perceptual equity theory has limitations, this study develops an alternative and non-perceptual framework for analysing such inequalities. Employment discrimination theory and elements of Rawls’s ‘Theory of Justice’ are the theoretical pillars of this framework. This article discusses the advantages of this approach for MNCs and identifies some expatriation practices that are fair according to our non-perceptual justice standards, whilst also reasonably (if not highly) efficient. También se analizan los desafíos éticos y políticos que plantea el cambio climático, como el desplazamiento climático y los derechos de las comunidades afectadas. El dossier promueve una ética ampliada que reconozca la interconexión entre humanos y naturaleza, y que confronte los paradigmas especistas y antropocéntricos. In nature scent is important for man primarily as a marker of food and sexual attractiveness, it polarizes as objects of life and decay, death. Scent, just like touch and taste exists till subject and object get opposed to each other, it is the sphere where body is included into material world, and flesh of the world is incrusted into the body. Aesthetics in its anthropologic meaning is limited by a body- perceptible dimension. Development of such categories as the sublime, (...) tragic, comic are not possible here. Creation of compound aromas, including those which do not exist in nature, can not overstep the limits of the beautiful- -ugly opposition. There is no contradiction, nourishing the comic, the tragic or the sublime, in blending of body with the world by means of scent. When speaking of a form of life, we consider one different from others by way of its mode of expression, that is, by its (...) means of construction. This interpretation lends itself to a functional analysis of the material put to use and whose operations jointly express the concept we are after. Modes of expression can be plotted between a rhetorical and semantic axis (Gates 48). As such, "[t]he level of connotation of the visual sign, of its contextual reference and positioning in different discursive fields of meaning and association, is the point where already coded signs intersect with the deep semantic codes of a culture and take on additional more active ideological dimensions" (Hall 56). Coordinates within this domain encode signifying practices, revitalizing the traditional concept of signification as a function of what's signified with respect to a signifier. The content of a syntagm in this coordinate system, a point in this plane, indexes its function with respect to others. As such, we will conceive of the content of modes of expression functionally.A function is defined by pairing an element from a domain and another from a sub/co-domain whereby that pair is an element of that function. In this way, we can treat functions as abstract objects. If we treat a domain as what determines the availability of an expression, and a sub/co-domain as representative of its range of application, then the function of applying some proposition maps a movement from a domain of selection to one of composition, that is, its use with respect to others. With that in mind, let us consider a coordinate system where there are two perpendicular axes, and we define positions within the space provided at the intersection of lines drawn from each. Each axis is represented by an ordered series of markers. A line drawn from each axis indicates that the coordinates indexed at their intersection is a function of these two markers. This locates an individual at a point in that domain, indexing a relation between the axes framing that space. Therefore, that coordinate-wise space, here a domain of possible expression, is not "empty" as pessimists would claim, but is filled with functional-content, albeit functions yet applied and marked by a point in that plane.Although we are currently speaking of two-dimensional space, the same follows for as many dimensions as we want. We use a fundamental theorem of Vaught, called the covering theorem in [V] (cf. theorem 0.1 below) as well as a generalization of it (cf. Theorem $0.1^\ast$ below) to derive several known and a few new results related to the logic $L_{\omega_1\omega}$. Among others, we prove that if every countable model in a $PC_{\omega_1\omega}$ class has only countably many automorphisms, then the class has either $\leq\aleph_0$ or exactly $2^{\aleph_0}$ nonisomorphic countable members (cf. Theorem $4.3^\ast$) and that the class of countable (...) saturated structures of a sufficiently large countable similarity type is not $PC_{\omega_1\omega}$ among countable structures (cf. Economic analysis is being applied by scholars to an increasing range of legal problems. This collection brings together some of the main contributions to an important area of this work, the economics of contract law. The essays and illuminating notes, questions, and introductions provided by the editor outline the Law and Economics framework for analyzing contractual relationships. The first two parts of the book present a number of useful concepts - adverse selection, moral hazard, and rent seeking - and a (...) general way of thinking about the economics of contracting and contract law. The remainder of the book considers a wide range of topics and issues. The recurring theme is that contracting parties want to assign the responsibility for adjusting to particular contingencies to the party best able to control the costs of adjustment. The adjustment problem is exacerbated by the fact that the parties might engage in various types of strategic behavior, such as opportunism, moral hazard, and rent-seeking. Many contract law doctrines can best be understood as attempts to replicate how reasonable parties might resolve this adjustment problem. (shrink)

Paulo, Ferreira Gullar defendeu a necessidade de se reinventar uma nova utopia para o tempo presente: “por isso mesmo, o fim do regime comunista provocou um vazio ideológico, que necessita ser preenchido, uma vez que a sociedade humana, sem utopia, torna-se inviável”. Trata-se da última dentre tantas reviravoltas em sua saudosa trajetória intelectual. Diante disso, discutimos aqui uma das principais contribuições para esse debate, presente Em um rabo de foguete: (...) trauma e cultura política em Ferreira Gullar, de Marcus Vinícius Furtado da Silva Oliveira. Neste livro, o autor procurou identificar e interpretar várias dessas reviravoltas presentes na vida intelectual do poeta e crítico literário maranhense. Notoriamente, algo que poderia enfraquecer o argumento de uma de suas teses centrais - no caso, o cancelamento das utopias em Ferreira Gullar – ao contrário, acabou por trazer ainda mais relevância para o trabalho, coincidentemente publicado no mesmo ano do texto de Gullar. The article examines the interpretation of the teaching of Wilhelm von Humboldt on language by Gustav Shpet together with Shpet’s perception of the influence of Kant’s philosophy on Humboldt. Special emphasis is laid on terminological analysis, the underlying thesis of this analysis being that words, terms and concepts are not the same thing: one and the same word or word combination can denote different terms, and the concept is a term in each particular doctrine. The object of critical analysis is (...) the function of Humboldt’s term “inner form of language” and the way this term was transformed, according to Shpet, into “the concept of inner form” over time by various thinkers — Plato, Plotinus, Goethe, Humboldt and others. The difference is analysed between the terms which Humboldt, Shpet and Kant denoted by the same word “concept”. Shpet’s position on the issue of Kant’s influence on Humboldt is analysed, notably in terms of the “schematism of the pure concepts of understanding”. Steinthal’s opinion on this issue allows us to raise the hermeneutic question of what kind of Kant a particular researcher is dealing with at a particular time — from the beginning of the nineteenth century until our days. The author notes the peremptory character of some of Shpet’s claims as well as his description of Kant’s influence on Humboldt as suggestion. The author also considers Shpet’s critique of subjectivism, which robs subjectivism of creativity and confines it to the capacity to convey what has been understood and to err. Finally, Shpet’s methodology (the question of identity and difference) and the role of terminology in his own works is considered. The positing of identity as the starting point of method accords with Shpet’s conviction that terms have meaning and explanatory power. Contrary to Shpet, it is difference that is the initial experience and the key term in phenomenological and post-phenomenological philosophy. (shrink)
